Eisner, LLP secured a victory for client CAA in a lawsuit brought by actor Terrence Howard over the agency’s handling of his “Empire” contract. The Los Angeles Superior Court dismissed the lawsuit, finding that Howard’s claims were too speculative to proceed to trial.
Howard had alleged a conflict of interest in CAA’s representation, claiming it led him to accept below-market pay across his six seasons on the series. In her ruling, Judge Cherol Nellon found the damages were too speculative to support a trial, noting that Howard’s fixed salary structure meant any renegotiated deal would not necessarily have resulted in additional payment to him.
The Eisner team representing CAA was led by Partner Jeremiah Reynolds and included Senior Counsel Eric Pettis and Cristyn Chadwick, and Associate Ari Wininger.
